happening now- the funeral for a nevada teacher -- gunned down by a student -- will be held later today. family and friends gathered yesterday -- to pay their respects to master sergeant michael landsberry. police say he died trying to intervene in last month's

shooting at sparks middle school. those who attended saturday's viewing say landsberry was more than a teacher. landsberry was a member of the nevada air national guard and a marine. his funeral is scheduled for three this afternoon. a new anti-smoking law is in effect in walnut creek. and, breaking the law could cost violators fines ranging from 100 to 500-dollars. but as kron four's philippe djegal explains. one city councilman is fighting to have the ban repealed. but the mayor of walnut creek doesn't agree. mayor cindy silva says despite what councilman wedel just told us. trying to repeal the smoking index of stories... councilman justin wedel says he's filed paperwork with the walnut creek city attorney to create an initiative. which would repeal the city's new second-hand smoking ordinance... and, create a new one with similar restrictions... only in his version, wedel says the city would be prohibited from banning smoking on private property. everywhere else he says would remain smoke free. wedel says the city's ban is unconstitutional... saying the council's four to one vote on the issue, favoring the ban, represents most of the city. wedel says he hopes to have his initiative on a 20- 14 ballot. but despite what wedel mayor silva says election or

one city councilman is fighting to have the ban repealed. but the mayor of walnut creek doesn't agree. mayor cindy silva says despite what councilman wedel just told us-- trying to repeal the smoking ordinance with a vote could be very expensive. silva says it could cost the city about 100-thousand dollars. she disagrees with councilman wedel's claim that the smoking ordinance is unconstitutional. silva added that the city did more than nine months of community outreach to gauge whether or not a ban was desired by most residents and businesses. and, in the end, silva says the council's four to one vote in favor of the ban is representative of the city. everyone on the floor now. >> reporter: federal prosecutors are now filing criminal charges against 23- year-old paul anthony ciancia. he is accused of opening fire with an assault rifle inside lax's terminal 3 killing 39- year-old tsa officer gerardo hernandez and wounding several others. he fired multiple rounds at point blank range at the tsa officer. hernandez's wife spoke briefly to reporters: gerardo would have been 40 next week. i am truly devastated. >> reporter: a man who came face to face with the gunman says the suspect seemed to be looking for tsa employees. . >> the shooter just calmly walking down the corridor. he had his gun and looked at me and said tsa? and i just shook my head, and he kept going. >> reporter: eventually, the fbi says law enforcement
